Draft — under legal review. This text has not been cleared by counsel. Points and rewards are not yet live; this chapter is published so that it can be read before they are, and it takes effect, as part of the Terms of Service, on the day the first point is issued and a cleared version is published.
This chapter governs the points a member can earn on the Platform and the rewards they can be exchanged for. It forms part of the Terms of Service.
1. What points are, and are not
Points are a record, kept by OpinVera, of contribution to the Platform. Points have no cash value, are not money, are not a deposit, are not a security, and are not a crypto-asset. They cannot be bought, sold, transferred, gifted, pooled or inherited, and they cannot be exchanged for cash from OpinVera or anyone else. They are a licence to claim the rewards in §4 while these terms allow it, and nothing more.
2. How points are earned
Points are issued for contribution that has settled: a ballot counts when the item's result is published and the ballot was counted in it, not when it is cast; an invitation counts when the invited member casts their first settled ballot. The number of points for each kind of contribution, the caps per day and per month, and any bonus are shown in the app before you act and may change on thirty (30) days' notice. Points already issued are not changed by a change to the earning rules.
3. Expiry, forfeiture and correction
- Points expire twelve (12) months after they are issued, oldest first, unless redeemed.
- Points are forfeited when the account is deleted, and the deletion confirmation says so before you confirm.
- Points earned through manipulation — coordinated voting, automated voting, invitation farming, or any breach of the Prohibited Content and Behavior Policy — are void, and we may remove them, reverse a reward obtained with them, and act on the account. We tell you what we did and why, and you may appeal under the Community Guidelines §5.
- We may correct a points balance to fix an error in either direction, and will tell you when we do.
4. Rewards
A reward is an offer listed by a publisher in the rewards catalogue — for example a period of access to the publisher's own service — which a member can claim with points. The publisher fulfils the reward; OpinVera brokers the claim. When you claim a reward you receive a redemption code to use with the publisher under the publisher's own terms. A reward has no cash alternative. The catalogue shows what each reward is, what it costs in points, and any conditions, before you claim it.
5. If a publisher does not honour a reward
If a publisher fails to honour a redemption code, tell us within thirty (30) days. We will ask the publisher to honour it and, if it does not within fourteen (14) days, we will return the points to your balance and may remove the offer from the catalogue. That is the extent of our liability for a publisher's failure to honour a reward.
6. No purchase, no in-app redemption
Points cannot be bought. On iOS and Android, points are shown as a number and rewards are claimed on the web, in accordance with the app stores' rules.
7. Taxes
Any tax arising from a reward you claim is your responsibility. We do not provide tax advice.
8. Changes and ending the programme
We may change these terms, the catalogue and the earning rules on thirty (30) days' notice, and may end the points programme on ninety (90) days' notice, during which points may still be redeemed for rewards then listed. Points not redeemed by the end of that period lapse.
